On the 28th of August 2023, the ECtHR published its communicated case no. 22399/22. The case concerned a married Iraqi couple, victims of violence, with two minor children who entered Poland irregularly and were committed to guarded centres for six months. The ECtHR questions whether the applicants were subjected to personal checks amounting to a treatment contrary to Article 3 and breaching their right to private life, and whether their detention violated Article 3, 5 and 8 ECHR.
