On the 9th of January 2023, the ECtHR published its communicated case Tsivilskaya v Poland, no. 55410/20. The case concerned a Russian national which received a residence permit in Poland, but was expelled on grounds of national security (espionage). The applicant complains that she was not given the opportunity to examine any evidence in her file because of confidentiality reasons which violated Article 6 and 13 of the Convention and Article 1 Protocol No 7. Tsivilskaya also declared that the expulsion violated her right to family life.
