On the 27th of February 2023, the ECtHR published its communicated case R.G. v. Switzerland, no. 30036/22. The case concerns a removal of an applicant from Switzerland to Russia (Chechnya). The applicant’s mother was granted refugee status in Switzerland, after which the applicant applied for asylum but his request was rejected for credibility reasons hence his return was ordered.
The applicant claims that he risks a treatment contrary to Articles 2 and 3 ECHR upon return. He also argues that Article 13 is breached because Switzerland did not examine potential repercussions of his mother’s asylum and the developments in Russia. Furthermore, the applicant claims that Switzerland did not consider the impact of his severe mental disorder in the credibility assessment.
