On the 3rd of July 2023, the European Court of Human Rights (ECtHR) published its communicated case no. 53952/22. The case concerns A.S.A, a Syrian national, who irregularly entered Hungary and expressed his wish to request international protection. The Hungarian police however took the applicant and another forty aliens to the external side of the border fence and made them go to Serbia. The ECtHR asks whether the applicant was collectively expelled, what the possibilities were to apply for international protection during his irregular stay and at the border crossing point, what the modalities were of the Hungarian embassy procedure in Serbia and whether Article 3 and 13 of the European Convention on Human Rights (ECHR) were breached.
