On the 3rd of July 2023, the ECtHR published its communicated case no. 48302/21. The case concerns a Turkish man who was married with a Hungarian woman with whom he had a daughter. The Turkish man received a permanent residence permit but his national settlement permit was refused based on a report stating that he was a threat to national security due to his imprisonment for causing serious bodily harm and so he received an expulsion order. The ECtHR asks whether the applicants’ right to family life was violated, whether they had an effective remedy and whether the expulsion order violated Article 1 § 1 of Protocol No. 7.
