On 30 July 2026, the Council of the European Union adopted the Implementing Decision (EU) 2026/1912 extending until 4 March 2028 temporary protection for persons displaced from Ukraine introduced by the Implementing Decision (EU) 2022/382. The Decision follows a proposal presented by the European Commission on 26 June 2026 and provides that the reasons justifying temporary protection continue to persist, as the situation in Ukraine does not allow the majority of displaced persons to return in safe and durable conditions.

The Decision also introduces a requirement concerning military obligations in Ukraine. Under Article 2, temporary protection shall only be granted, where applicable, to persons who provide proof that they satisfy their military obligations in Ukraine. This requirement does not apply to persons who were already enjoying temporary protection in a Member State on or before 30 July 2026 and who continuously retain that status in that Member State. The Decision specifies that evidence may include proof of lawful departure from Ukraine or an official document confirming exemption from, or compliance with, military obligations.

The extension applies from 5 March 2027, while the new requirement concerning military obligations applies from 31 July 2026. The Decision entered into force on the day following its publication in the Official Journal of the European Union.
