On the 2nd of March 2023, the ECtHR delivered its decision in A.K. and A.S. against Greece, no. 45337/20. The case concerned a Syrian woman and her newborn baby living in the forest outside the Samos “hotspot”. The Court granted interim measures requiring the Government to guarantee the applicants’ living conditions compatible with Article 3 ECHR considering their state of health, and to provide adequate healthcare.

The applicants complained under Article 3, 8 and 13 ECHR regarding their living conditions and the lack of an effective remedy. Greece submitted its observations but the applicants did not respond. Consequently, the Court decided to strike out the application under Article 37(1) ECHR.
