On the 13th of January 2023, the ECtHR communicated its case Abduladze v. Spain no. 41105/22. The case concerned an extradition of a Georgian applicant to Russia who allegedly applied for asylum in Spain. The Russian officials provided diplomatic assurances stating that he will not be treated contrary to Article 3 ECHR on return, receive every defence opportunity, and that Spain may conduct monitor visits.

The ECtHR questions whether Spain considered the risks of a treatment violating Article 3 on return and whether Russia’s assurances provide sufficient guarantees against such treatment.
